【新聞稿】立即終止性別暴力:關於近期移工性侵案件增加的聲明

桃園市群眾服務協會,移工國際台灣分會(Migrante Taiwan)與全國家戶勞動產業工會(National Domestic Workers Union)共同對最新政府數據表示強烈憤慨:去年台灣移工涉及的強暴通報案件高達169件。每一個數字背後,都是一位受害者的身體、尊嚴與安全在台灣的勞動與移民體制中持續受到忽視。

雖然官方宣稱案件數「只是回到疫情前的水平」,卻未正視這些暴力之所以持續存在的系統性問題。移工,尤其是住家照護者與家庭幫傭,在雇主家中常面臨極高的性騷擾與性暴力風險。根據桃園市群眾服務協會(SPA)於2023年所做的調查,16%的移工曾遭遇性別暴力,幾乎是一般勞工的四倍;其中,有六成受害者遭遇過多次性侵害。此外,多數受害者因恐懼或限制而未通報,顯示實際暴力規模遠比官方統計更為嚴重。

台灣經常以民主與人權紀錄為傲,但那些照顧台灣長者、支撐經濟運轉的移工,卻仍未享有最基本的保障。看護工和家庭幫傭被排除在《勞動基準法》之外,而申訴機制不僅難以進入,對於選擇站出來的人也無法提供有效協助。此外,20%的受害者在事件發生當下與事後都無法採取任何行動。家庭移工沒有法定休息時間,形同全年無休,使她們難以在台灣建立互助網絡。再者,宿舍管理與工作場所的高度控制剝奪身體自主,而仲介則從移工的依賴與沉默中牟利。

因此,我們認為必須建立更透明、友善且具文化敏感度的協助機制,確保受害者在面對性別暴力時能獲得適切的支持與保護。我們呼籲:
● 將所有移工看護與家庭幫傭全面納入《勞動基準法》保障
● 強化對家庭及工廠中性暴力的查察與執法
● 讓移工不需雇主同意即可轉換雇主,使受害者能安全逃離暴力工作場所,避免遭遣返
● 追究包庇、縱容或實施性暴力的仲介與雇主責任
● 制定政策與改革機制時,積極與移工自主組織諮商合作

衛福部官員郭彩榕曾強調對性侵害「零容忍」。我們在此呼籲她與台灣政府,將這份「零容忍」真正落實為具體行動,而非停留在口號之上。移工必須在家中、職場、以及台灣社會的每一處都能獲得真正的安全保障。人的尊嚴不應有國界。

Stop Gender Based Violence Now: Statement On The Recent Report of Increased Sexual Assault Cases Against Migrant Workers
Serve The People Association – Taoyuan, Migrante Taiwan and the National Domestic Workers Union jointly express our outrage amid new government data showing 169 reported rape cases involving migrant workers in Taiwan last year. Each statistic represents a victim whose body, dignity, and safety continued to be neglected within Taiwan’s labor and migration regime.
While officials have reassured that cases have merely returned to “pre-pandemic levels”, they fail to confront the systemic violence that enables this abuse to persist. Migrant workers, especially live-in caregivers and domestic employees, often face great risk of sexual harassment and assault in their employer’s home. A study conducted by Serve The People Association (2023) noted that 16% of migrant workers reported experiencing gender violence—nearly four times higher than ordinary workers. Of these, 60% of victimized migrant workers experienced multiple incidents of sexual assault. Additionally, many endure repeated violations without ever reporting, meaning the real scale of this violence could be greater than what official statistics reveal.
Even as Taiwan boasts about its democratic freedoms and human rights record, migrants who care for Taiwan’s elderly and power the economy remain denied the most basic protections. Caregivers are excluded from the Labor Standards Act while complaint mechanisms are often difficult to access or remain unhelpful for those who choose to come forward. Additionally, 20% of victims find themselves unable to take any action at the moment or afterwards. Domestic workers also do not enjoy statutory rest periods, effectively being on the job 24/7, which makes it challenging for them to establish mutual support networks in the country. Furthermore, dorm arrangements and workplace controls undermine bodily autonomy while brokers profit from migrant workers’ dependency and silence.
There is a need to establish more transparent, friendly, and culturally sensitive assistance mechanisms to ensure that victims receive appropriate support and protection when facing gender-based violence. Thus we call for:
1. Full labor protection under the Labor Standards Act for all migrant caregivers and domestic workers.
2. Stronger enforcement against sexual violence in both homes and factories.
3. Employment mobility without employer consent, so that survivors can flee abusive workplaces without risking deportation
4. Accountability for brokers and employers who enable, cover up, or perpetuate abuse.
5. Active consultation with migrant-led organizations in designing support systems and policy reforms.
Kuo-Tsai Jung of the Ministry of Health and Welfare emphasized a “zero-tolerance” attitude towards sexual assault. We thus call unto her and the Taiwanese government to ensurethat such “zero-tolerance” turns into concrete action rather than just remain a slogan. Migrant workers must be safe not only in statistics, but in their daily lives be it at home, work, or anywhere in Taiwan. Dignity for human life knows no borders.
